The Post’s Kessler awarded three of his “Pinocchios” to the Obama camp’s claim that SEC filings show Romney might be guilty of a felony. Kessler notes (among other things) that Romney’s time at the Olympics was the subject of hearings before the Massachusetts Ballot Law Commission in 2002, when Democrats sought and failed to disqualify Romney as a candidate for governor on grounds that he had been living in Utah. Andrea Tantaros called the ordeal “a stretch,” going on to note that “arming Mexican drug cartels” is what sounds like a felony to her. She then took a look at the Obama family tree, citing two relatives who were undocumented in this country. And then there’s Obama himself. DNC Chairwoman Debbie Wasserman Schultz was on MSNBC this morning and, when confronted with the irresponsibilty of the accusation, chose to double down [video below]: "What Stephanie [Cutter] said, rightfully so, is that either Mitt Romney was lying on SEC forms and misrepresenting to his investors -- which could be a felony -- that he was the sole owner, president, CEO of Bain Capital from 1999 until almost the end of 2001, or he wasn't and represented that he was."

CNN reported last night that the accusations from Team Obama of felonious conduct are sheer nonsense and lies — and got that message from four executives at Bain, two of whom are “active” supporters of Barack Obama. John King spoke to all four, three of whom are Democrats, and all four said that Mitt Romney left Bain in a big hurry in 1999 in order to work full time on rescuing the Salt Lake City Olympics. The rushed departure created a lot of paperwork headaches as Bain tried to unwind Romney from leadership, which required a significant amount of time. That’s why the company had Romney’s name on their SEC paperwork the next two years, as King reports

Obama deputy campaign manager Stephanie Cutter suggested that Mitt Romney may be a criminal on a conference call with reporters this morning about a Boston Globe report that shows that Romney stayed at Bain Capital three years past when he said he'd left.

Today he acknowledged that “all these attacks [by Team Obama] may be hurting the president’s brand a little bit.” For this reason, Rendell concluded that “our supporters went a little bit too far with the felony business” — i.e., the suggestion that Mitt Romney committed a felony with respect to his sworn statements about his role with Bain Capital.
